The August 10 Deadline for Tipped Employees

If you earn tips—whether you are working a secondary hospitality job while building a self-employed business or taking on seasonal service work—the IRS has a strict reporting rule you must follow. If you received more than $20 in tips during the month of July, you are legally required to report that exact total to your employer no later than August 10.

To fulfill this requirement, you can use IRS Form 4070 (Employee’s Report of Tips to Employer) or provide your own written statement. If you draft your own statement, it must include your signature, full name, address, Social Security number, your employer’s name and address, the specific month covered, and the total amount of tips you received.

How Employers Handle Tip Withholding

Once you submit your report, the responsibility shifts to the business. Your employer must use your regular wages to withhold the necessary FICA taxes (Social Security and Medicare) as well as the standard income tax withholding for those tips.

If your regular paycheck is not large enough to cover the taxes owed on your reported tips, your employer will report the uncollected amount in Box 8 of your W-2 at year-end. You are then responsible for paying that uncollected withholding when you file your annual tax return.

We see this frequently when handling individual tax preparation. An unexpected tax bill resulting from uncollected tip withholding can quickly disrupt your cash flow. Understanding this mechanism allows you to set aside funds now rather than scrambling during tax season.

Navigating Weekends and Federal Holidays

Tax deadlines are generally rigid, but the IRS does offer a small cushion when the calendar shifts. If any standard tax due date happens to fall on a Saturday, Sunday, or a legal federal holiday, the deadline is automatically extended. In these scenarios, you have until the very next business day that is not a weekend or holiday to submit your forms.
